B. We seek to promote, encourage and facilitate the safe, constructive and robust use of the services and Content of the Site in the interest of you and all other users of the Site. This shall require and be dependent upon the appropriate and legal use of the technologies, facilities, services and Content made available to you and all others of the Site.

3 Acceptable Use of the Site

A. The Site is for your personal, non-commercial and non-exclusive use only. As long as you comply with this Policy and the Terms of Use PHOTOSYMBOLS grants you a personal, non-exclusive, non-transferable, and non-commercial limited privilege to enter and use the Site.

B. The Site is primarily to be used for the following: Access to pictures and templates for accessible information (easyread)

C. Use of the Site in any other way, including in contravention of any restriction on use set out in this Policy, is not permitted. If you do not agree with the terms of this Policy, you may not use the Site.

D. Restrictions:

I. As a condition of your use of the Site, you agree:

(a). not use the Site for any purpose that is unlawful under any applicable law or prohibited by this Policy or our website terms and conditions of use;

(b). not access the Site in any manner that is prohibited by this Policy or our website terms and conditions of use;

(c). not to use the Site to commit any act of fraud;

(d). not to use the Site to distribute viruses or malware or other similar harmful software code;

(e). not to use the Site for purposes of promoting unsolicited advertising or sending spam;

(f). not to use the Site to simulate communications from us or another service or entity in order to collect identity information, authentication credentials, or other information ('phishing');

(g). not to use the Site in any manner that disrupts the operation of our Site or business or the website or business of any other entity; (h). not to use the Site in any manner that harms minors;

(l). not to attempt to circumvent password or user authentication methods; and

(m). to comply with the provisions relating to our intellectual property rights and software contained in our website terms and conditions of use.

(n). not to use, reproduce, duplicate, copy, sell, resell or exploit any portion of the Site, including any photographs, images, text, or other content for artificial intelligence (AI) training, machine learning, or any form of automated data collection and analysis without our express written permission. This includes, but is not limited to, the use of our Site’s content for developing AI models, machine learning algorithms, or any other type of data analysis or data mining tools.

4. Interactive services

A. We may make bulletin boards, chat rooms, comments board, reviews or other communication services which invite Submissions ('Interactive Services') available on the Site.

B. We are not obliged to monitor or moderate Submissions to Interactive Services.

C. We may remove or edit any Submissions to any of Interactive Services whether they are moderated or not.

D. Any Submission you make must comply with our Submission standards set out below.

5. Submission standards

Any Submission or communication to users of our Site must conform to standards of accuracy, decency and lawfulness, which shall be applied in our discretion, acting reasonably. In particular, you warrant that any Submission or communication is:

I. your own original work and lawfully submitted;

II. factually accurate or your own genuinely held belief;

III. provided with the necessary consent of any third party;

IV. not defamatory or likely to give rise to an allegation of defamation;

V. not offensive, obscene, sexually explicit, discriminatory or deceptive; and

VI. unlikely to cause offence, embarrassment or annoyance to others.

6. Using our trademarks, logos or trade names

A. You may only use our trademarks, logos or trade names with our prior written permission. Any other use is prohibited.

B. In the event that you are given such permission you may only use our trademarks, logos or trade names in accordance with the strict limits of such permission and any guidelines imposed by us.

7. Breach

We shall apply the terms of this Policy in our absolute discretion. In the event of your breach of this Policy we may terminate or suspend your use of the Site, remove or edit Submissions, disclose Submissions to law enforcement authorities or take any action we consider necessary to remedy the breach.

8. Disputes

A. We will try to resolve any disputes with you quickly and efficiently.

B. If you are unhappy with us please contact us as soon as possible.

C. We shall always endeavour to resolve any problem or issue that may arise between you and us as efficiently and smoothly as possible, however where this is not possible and you wish to raise a formal complaint, we can be contacted in the following ways:

D. We shall always aim to remedy your complain immediately. Where such remedy is not available immediately we shall acknowledge receipt of your complaint in writing within 14 working days of the complaint being made.

Where your complaint concerns services provided by us through the Site we shall aim to give you our response within 28 days after the complaint has been received by us.

Where the complaint relates to exceptional circumstances which are beyond our control, such circumstances include but are not limited to: internet service provider failure; power failure; acts of God; pandemic; epidemic; fire; flood; droughts; storms; civil unrest; collapse of buildings; earthquakes; explosion; accidents; acts of war or terrorism; or any law or actions taken by government or public authorities or any other event that is beyond our control we shall aim to respond to your complaint within a maximum of 90 working days of the complaint being made.

If your complaint does not relate to any service provided by us through the Site we shall aim to provide a response to your complaint within 90 weeks of the complaint being made and where we shall take longer than 90 weeks we shall inform you of this.

E. If you and we cannot resolve a dispute using our complaint handling procedure, we will: I. let you know that we cannot settle the dispute with you; and II. give you certain legally required information about an alternative dispute resolution provider.

F. If you want to take court proceedings, the relevant courts of the United Kingdom will have exclusive jurisdiction in relation to these Terms.

G. Relevant United Kingdom law will apply to these Terms.
